BY PARTICIPATING IN THE GIVEAWAY (DEFINED BELOW), YOU (THE PARTICIPANT) AGREE TO THESE OFFICIAL RULES (“RULES”), WHICH IS A CONTRACT. THIS CONTRACT INCLUDES, AMONG OTHER TERMS, A LIMITATION OF YOUR RIGHTS AND REMEDIES. AS MORE FULLY DETAILED BELOW, YOU AGREE THAT ALL DISPUTES ASSOCIATED WITH THE PROMOTION WILL BE DECIDED BY THE TRIBAL COURT OF THE POARCH BAND OF CREEK INDIANS, A FEDERALLY RECOGNIZED INDIAN TRIBE.

I. Eligibility: This giveaway is open only to those who are 21 years of age or older as of the date of entry and not on any exclusion list or banned/evicted list maintained or enforced by Wind Creek Bethlehem, or its affiliates. This 7 Wonders of Wind Creek Social Media giveaway (“Giveaway”) is only open to legal residents of the United States and is void where prohibited by law. Employees of Wind Creek Bethlehem, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of an Employee are not eligible to participate in the Giveaway. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. 

II. Agreement to Rules: By participating, the contestant/participant/entrant (“You”) agrees to be fully and unconditionally bound by these Rules, and by such entry You represent and warrant that You meet all eligibility requirements. In addition, You agree to accept any and all decisions of Wind Creek Bethlehem final and binding as it relates to the Giveaway, and Your eligibility to win. 

III. 7 Wonders of Wind Creek Period: Entries will be accepted online starting on July 1, 2025, at approximately 12:00AM Eastern Time, and ending on July 31, 2025, at approximately 11:59PM Eastern Time. All online entries must be received by July 31, 2025, at approximately 11:59PM Eastern Time to be eligible to win.  

IV. How To Enter: To enter the Giveaway, Guests must be twenty-one (21) years of age or older to enter and cannot be on any self-exclusion lists. Guests can visit Winners Way (located at Wind Creek Bethlehem) between 6 pm Eastern time – 10 pm Eastern time on Fridays in July to receive a free 7 Wonders of Wind Creek Sticker. Stickers may only be picked up during the established time frame. Guests can enter up to four (4) times. Guests must take a picture or selfie with the 7 Wonders of Wind Creek Sticker in-frame (photos are not permitted on the Casino Floor, or even from a distance, and any Casino floor pictures will be disqualified), post it on their Facebook page–in the post, tag Wind Creek Bethlehem, and use the #7WondersWCB hashtag in the post copy. Therefore, to make a valid entry, You must take a picture or selfie with the 7 Wonders of Wind Creek Sticker in-frame (photos are not permitted on the Casino Floor, or even from a distance, and any Casino floor pictures will be disqualified). post it on the their Facebook page–in the post, tag Wind Creek Bethlehem, and use the #7WondersWCB hashtag in the post copy. Neither Facebook nor Wind Creek Bethlehem is responsible for your failed entry attempts, including those resulting from issues with your picture or selfie or 7 Wonders of Wind Creek Sticker, even if such issues are caused by Facebook or Wind Creek Bethlehem. 

By entering the 7 Wonders of Wind Creek Social Media Giveaway, You agree to abide by these Rules and, by Your entry, You represent that Your Facebook posts, comments and any other forms of engagement submitted by You are completely Your own original work and such do not infringe upon or violate the rights of any third party, including intellectual property rights, copyrights, or rights of privacy or publicity.  

Your entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to these Rules or specifications may be disqualified at the sole discretion of Wind Creek Bethlehem. You may only enter four (4) times, and You must provide all the information requested. You may not enter the Giveaway more than four (4) times by using multiple accounts, identities, or devices to circumvent these, Rules. If You use fraudulent methods or otherwise attempt to circumvent these Rules, all Your entries may be removed from eligibility at the sole discretion of Wind Creek Bethlehem. 

V. Prize: The eligible winner of the Giveaway will receive a trip for two (2) to any Wind Creek property including airfare ($2,000 value), a  four (4) night, five (5) day hotel stay at the chosen Wind Creek Property, an all-inclusive food and beverage package (varies based on destination),; totaling an estimated six-thousand-dollar value ($6,000). Taxes, gratuity, and transportation to/from the airport are not included. The specifics of the prize (including no buyouts, non-transferable, and the winner/plus one (1) must be twenty-one (21) years old) shall be solely determined by Wind Creek Hospitality.  There is only one (1) winner per property, and the winner cannot win more than once across all Wind Creek properties. Travel must be booked by December 2025, and travel must occur by March 2026. No cash or other prize substitution shall be permitted, except at Wind Creek Bethlehem’s sole discretion. All prizes are non-transferable. Any prize-related expenses, including all federal, state, and/or local taxes, shall be the sole responsibility of the winners. No substitution of prize or transfer/assignment of prize to others or request the cash equivalent by a winner is permitted. Acceptance of any prize constitutes permission by You for Wind Creek Bethlehem to use the You're and the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law. 

VI. Odds: The odds of winning depend on the number of eligible entries received.

VII. Winner Selection and Notification: The winner will be selected by random under the supervision of agents of Wind Creek Bethlehem. The winners will be notified on Wind Creek Bethlehem’s Facebook page within 72 hours following selection. Wind Creek Bethlehem shall have no liability for any winner’s failure to receive notices due to spam, junk e-mail or other security settings or for the winner’s provision of incorrect or otherwise non-functioning contact information. If any winner cannot be contacted, fails to claim the prize within seventy-two (72) hours from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the winner’s prize may be deemed forfeited by Wind Creek Bethlehem in its sole discretion, and an alternate winner may be selected. Receipt by the winner of the prize offered in the 7 Wonders of Wind Creek Social Media Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations as well as winner’s execution of a declaration and release in favor of Wind Creek Bethlehem. ANY VIOLATION OF THESE RULES BY WINNER (AT WIND CREEK BETHLEHEM’s SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS A WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering the Own the Throne Giveaway, You understand and agree that Wind Creek Bethlehem and anyone acting on behalf of Wind Creek Bethlehem, Wind Creek Bethlehem’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, Your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. Acceptance of tickets constitutes the winner’s permission to use his/her likeness and name for publicity and/or promotional uses without compensation. To be a winner, You must sign a publicity release. 

IX. Terms & Conditions: Wind Creek Bethlehem reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should any virus, bug, non-authorized human intervention, fraud, or other cause beyond Wind Creek Bethlehem’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, Wind Creek Bethlehem may select winners from all eligible entries received prior to and/or after (if appropriate) the underlying cause beyond Wind Creek Bethlehem’s control. Wind Creek Bethlehem reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Rules.  Wind Creek Bethlehem has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to, multiple entries from the same user from different IP addresses. Multiple entries from the same computer in excess of that allowed by Giveaway Rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway shall be a violation of these Rules and result in disqualification. Should such attempt be made, Wind Creek Bethlehem reserves the right to seek damages to the fullest extent permitted by law. 

X. Limitation of Liability: By entering the 7 Wonders of Wind Creek Giveaway, You agree to release and hold harmless Wind Creek Bethlehem and its owners, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the Giveaway and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; and/or (v) electronic or human error in the administration of the Promotion or the processing of entries. 

XI. Disputes: Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF PENNSYLVANIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resorting to any form of class action, exclusively before a court of competent jurisdiction in Northampton County, PA. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and You hereby waive all right to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than your actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway). You further waive all rights to have damages multiplied or increased. To the fullest extent allowed by law, You agree any litigation related to the Giveaway shall be by bench trial, and You further waive any right to a jury trial.

Requests must be received no later than (5) days after the first of every month.
