Eligibility: This giveaway is open only to those who are 21 years of age or older as of the date of entry and not on any exclusion list or banned/evicted list maintained or enforced by Wind Creek Atmore, or its affiliates. This 12 Days of Wind Creek Social Media giveaway (“Giveaway”) is only open to legal residents of the United States and is void where prohibited by law. Employees of Wind Creek Atmore, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of an Employee are not eligible to participate in the Giveaway. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

Agreement to Rules: By participating, the contestant/participant/entrant (“You”) agrees to be fully and unconditionally bound by these Rules, and by such entry You represent and warrant that You meet all eligibility requirements. In addition, You agree to accept any and all decisions of Wind Creek Atmore as final and binding as it relates to the Giveaway, and Your eligibility to win.

12 Days of Wind Creek Social Media Giveaway Period: Entries will be accepted online on Wind Creek Atmore’s Facebook page starting on December 2, 2025, at approximately 8:00AM Central Standard Time, and ending on December 24, 2025, at approximately 11:59PM Central Standard Time. All online entries must be received by December 24, 2025, at approximately 11:59PM Central Standard Time to be eligible to win. 

How To Enter: To enter the Giveaway, participants (“Guests”) must be twenty-one (21) years of age or older and must not be on any self-exclusion or exclusion lists. Beginning December 2, 2025 at 8:00 AM Central Standard Time, and continuing through December 24, 2025 until 11:59 PM Central Standard Time, Wind Creek Atmore will post one (1) photo or video on its official Facebook page on December 2, December 4, December 6, December 8, December 10, December 12, December 14, December 16, December 18, December 20, December 22, and December 24, 2025 at 8:00 AM Central Standard Time as part of the 12 Days of Wind Creek Giveaway. Each post will feature a specific Christmas tree or holiday decoration located somewhere on the Wind Creek Atmore property and include the hashtag #12DaysofWindCreek.

To receive an entry for that day, Guests must:

• Visit Wind Creek Atmore in person between December 2, 2025 at 8:00 AM Central Standard Time and December 24, 2025 at 11:59 PM Central Standard Time
• Locate the featured tree or decoration (check Wind Creek Atmore’s official Facebook page to view the applicable date’s tree or decoration)
• Take a photo or selfie with you and the identified tree or decoration clearly in-frame.
• Comment on Wind Creek Atmore’s “12 Days of Wind Creek” Facebook post with a photo or selfie with you and the identified dates’ tree or decoration clearly in-frame.
• Include the hashtag #12DaysofWindCreek in the comment.

Each valid comment with a qualifying photo/selfie counts as one (1) entry for that comment window of the giveaway. Guests may earn one (1) entry for each comment window (see below for dates and times), for a total of twelve (12) entries, provided they complete the above steps before the next comment window opens.

By entering the 12 Days of Wind Creek Social Giveaway, You agree to abide by these Rules and, by Your entry, You represent that Your Facebook posts, comments and any other forms of engagement submitted by You are completely Your own original work and such do not infringe upon or violate the rights of any third party, including intellectual property rights, copyrights, or rights of privacy or publicity. 

Your entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to these Rules or specifications may be disqualified at the sole discretion of Wind Creek Atmore. You may only enter (4) times, and You must provide all the information requested.  You may not enter the Giveaway more than (4) times by using multiple accounts, identities, or devices to circumvent these Rules. If You use fraudulent methods or otherwise attempt to circumvent these Rules, all Your entries may be removed from eligibility at the sole discretion of Wind Creek Atmore.

One winner of the Giveaway will receive a prize valued at over $500. This prize includes: a two-night (2) complimentary hotel stay at Wind Creek Atmore ($318 total value at $159 per night), along with a ($250) resort credit to be used during the stay. The resort credit may be applied toward the Entertainment Center, Food and Beverage purchases, FIRE Steakhouse, or services from the Spa at Wind Creek. Taxes, gratuity, and transportation are not included. The specifics of the prize (including no buyouts, non-transferable, and the winner/plus one (1) must be twenty-one (21) years old) shall be solely determined by Wind Creek Hospitality.  There is only one (1) winner. Hotel must be booked by December 2026. No cash or other prize substitution shall be permitted, except at Wind Creek Atmore’s sole discretion. All prizes are non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winners. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by a winner is permitted. Acceptance of any prize constitutes permission by You for Wind Creek Atmore to use Your and the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.

Odds: The odds of winning depend on the number of eligible entries received.

Winner Selection and Notification: The winner will be selected by random under the supervision of agents of Wind Creek Atmore. The winner will be notified on Wind Creek Atmore’s Facebook page within 72 hours following selection. Wind Creek Atmore shall have no liability for any winner’s failure to receive notices due to spam, junk e-mail or other security settings or for the winner’s provision of incorrect or otherwise non-functioning contact information. If any winner cannot be contacted, fails to claim the prize within seventy-two 72 hours from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the winner’s prize may be deemed forfeited by Wind Creek Atmore in its sole discretion, and an alternate winner may be selected. Receipt by the winner of the prize offered in the 12 Days of Wind Creek Social Media Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations as well as winner’s execution of a declaration and release in favor of Wind Creek Atmore. ANY VIOLATION OF THESE RULES BY WINNER (AT WIND CREEK ATMORE’s SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS A WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
 

Rights Granted by You: By entering the 12 Days of Wind Creek Social Media Giveaway, You understand and agree that Wind Creek Atmore, and anyone acting on behalf of Wind Creek Atmore, Wind Creek Atmore’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, Your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. Acceptance of tickets constitutes the winner’s permission to use his/her likeness and name for publicity and/or promotional uses without compensation. To be a winner, You must sign a publicity release.
 

Terms & Conditions: Wind Creek Atmore reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should any virus, bug, non-authorized human intervention, fraud, or other cause beyond Wind Creek Atmore’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, Wind Creek Atmore may select winners from all eligible entries received prior to and/or after (if appropriate) the underlying cause beyond Wind Creek Atmore’s control. Wind Creek Atmore reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Rules.  Wind Creek Atmore has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to, multiple entries from the same user from different IP addresses. Multiple entries from the same computer in excess of that allowed by Giveaway Rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway shall be a violation of these Rules and result in disqualification. Should such attempt be made, Wind Creek Atmore reserves the right to seek damages to the fullest extent permitted by law.

Limitation of Liability: By entering the 12 Days of Wind Creek Social Media Giveaway, You agree to release and hold harmless Wind Creek Atmore and its owners, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the Giveaway and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; and/or (v) electronic or human error in the administration of the Promotion or the processing of entries.
 

Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE POARCH BAND OF CREEK INDIANS WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resorting to any form of class action, exclusively before the Tribal Court for the Poarch Band of Creek Indians. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and You hereby waive all right to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than your actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway). You further waive all rights to have damages multiplied or increased. To the fullest extent allowed by law, You agree any litigation related to the Giveaway shall be by bench trial, and You further waive any right to a jury trial.
