I. Eligibility: This giveaway is open only to those who are 21 years of age or older as of the date of entry and not on any exclusion list or banned/evicted list maintained or enforced by Wind Creek Montgomery, or its affiliates. This I Love The 90s Tour Ticket Giveaway (“Giveaway”) is only open to legal residents of the United States and is void where prohibited by law. Employees of Wind Creek Montgomery, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of an Employee are not eligible to participate in the Giveaway. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

II. Agreement to Rules: By participating, the contestant/participant/entrant (“You”) agrees to be fully and unconditionally bound by these Rules, and by such entry You represent and warrant that You meet all eligibility requirements. In addition, You agree to accept any and all decisions of Wind Creek Montgomery as final and binding as it relates to the Giveaway, and Your eligibility to win.

I Love The 90s Tour Ticket Giveaway Period: Entries will be accepted online on both Wind Creek Montgomery’s Facebook page and the @windcreekmontgomery Instagram page starting on November 24th, 2025, at approximately 10:00 a.m., Central Time, and ending on December 1st, 2025, at approximately 10:00 a.m., Central Time. All online entries must be received by December 1st, 2025, at approximately 10:00 a.m., Central Time to be eligible to win.

There are two (2) ways to enter the Giveaway:

1. Facebook Entry: To enter the Giveaway via Facebook, You must like and also comment on the Giveaway Facebook post located on Wind Creek Montgomery’s Facebook page. Therefore, to make a valid entry, You must both like and also comment (via Facebook’s system) on Wind Creek Montgomery’s Facebook Giveaway post. Neither Facebook nor Wind Creek Montgomery are responsible for any failed entry attempt by You. Neither Facebook nor Wind Creek Montgomery

are responsible for any Facebook like or comment failure that results in an ineligible entry by You—regardless of reason, even if such failure is the fault of Facebook or of Wind Creek Montgomery.

2. Instagram Entry: To enter the Giveaway via Instagram, You must follow @windcreekmontgomery on Instagram, then You must like and also comment on the Giveaway Instagram post located on the @windcreekmontgomery Instagram page. Therefore, to make a valid entry, You must follow @windcreekmontgomery on Instagram, like, and also comment (via Instagram’s system) on the @windcreekmontgomery Instagram Giveaway post. Neither Instagram nor Wind Creek Montgomery are responsible for any failed entry attempt by You. Neither Instagram nor Wind Creek Montgomery are responsible for any Instagram like or comment failure that results in an ineligible entry by You—regardless of reason, even if such failure is the fault of Instagram or of Wind Creek Montgomery.

By entering the I Love The 90s Tour Ticket Giveaway, You agree to abide by these Rules and, by Your entry, You represent that Your posts, comments and any other forms of engagement submitted by You are completely Your own original work and such do not infringe upon or violate the rights of any third party, including intellectual property rights, copyrights, or rights of privacy or publicity.

Your entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to these Rules or specifications may be disqualified at the sole discretion of Wind Creek Montgomery. You may enter once per platform, one (1) entry on Facebook and one (1) entry on Instagram, for a maximum of two (2) total entries, and you must provide all the information requested. You may not enter the Giveaway multiple times on one platform by using multiple accounts, identities, or devices to circumvent these Rules. If You use fraudulent methods or otherwise attempt to circumvent these Rules, all Your entries may be removed from eligibility at the sole discretion of Wind Creek Montgomery.

V. Prizes: Five (5) eligible winners will each receive two (2) General Admission tickets to the I Love The 90s Tour concert at Wind Creek Montgomery (approximate retail value: $59.70 USD per ticket; total ARV: $119.4 per winner, $597 total). Prize includes admission only, valid for the duration of The I Love The 90s Tour concert taking place on December 13th, 2025, at Wind Creek Montgomery.

Wind Creek Montgomery has no liability if the concert is canceled regardless of reason, including but not limited to weather. The specifics of the ticket prize (including seating location(s)) shall be solely determined by Wind Creek Montgomery. There is a total of five (5) possible winners who will be selected. No cash or other prize substitution shall be permitted, except at Wind Creek Montgomery’s sole discretion. All prizes are non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of each winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by a winner is permitted. Acceptance of any prize constitutes permission by You for Wind Creek Montgomery to use your name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.

Odds: The odds of winning depend on the number of eligible entries received.

VI. Winner Selection and Notification: The winners will be selected by random under the supervision of agents of Wind Creek Montgomery. The Winners will be notified on Wind Creek Montgomery’s Facebook page within three (3) days following selection. Wind Creek Montgomery shall have no liability for any winner’s failure to receive notices due to spam, junk e-mail or other security settings or for any winner’s provision of incorrect or otherwise non-functioning contact information. If any winner cannot be contacted, fails to claim the prize within three (3) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, that winner’s prize may be deemed forfeited by Wind Creek Montgomery in its sole discretion, and an alternate winner may be selected. Receipt by each winner of the prize offered in the I Love The 90s Tour Ticket Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations as well as winner’s execution of a declaration and release in favor of Wind Creek Montgomery. ANY VIOLATION OF THESE RULES BY WINNER (AT WIND CREEK MONTGOMERY’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS A WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering the I Love The 90s Tour Ticket Giveaway, You understand and agree that Wind Creek Montgomery, and anyone acting on behalf of Wind Creek Montgomery, Wind Creek Montgomery’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, Your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. Acceptance of tickets constitutes each winner’s permission to use his/her likeness and name for publicity and/or promotional uses without compensation. To be a winner, You must sign a publicity release.

Terms & Conditions: Wind Creek Montgomery reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should any virus, bug, non-authorized human intervention, fraud, or other cause beyond Wind Creek Montgomery’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. Limitation of Liability: By entering the I Love The 90s Tour Ticket Giveaway, You agree to release and hold harmless Wind Creek Montgomery and its owners, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the Giveaway and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; and/or (v) electronic or human error in the administration of the Promotion or the processing of entries.

X. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES

AND THE POARCH BAND OF CREEK INDIANS WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resorting to any form of class action, exclusively before the Tribal Court for the Poarch Band of Creek Indians. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and You hereby waive all right to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Your actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway). You further waive all rights to have damages multiplied or increased. To the fullest extent allowed by law, You agree any litigation related to the Giveaway shall be by bench trial, and You further waive any right to a jury trial.
