BY PARTICIPATING IN THE GIVEAWAY (DEFINED BELOW), YOU (THE PARTICIPANT) AGREE TO THESE OFFICIAL RULES (“RULES”), WHICH IS A CONTRACT. THIS CONTRACT INCLUDES, AMONG OTHER TERMS, A LIMITATION OF YOUR RIGHTS AND REMEDIES. AS MORE FULLY DETAILED BELOW, YOU AGREE THAT ALL DISPUTES ASSOCIATED WITH THE PROMOTION WILL BE DECIDED BY THE TRIBAL COURT OF THE POARCH BAND OF CREEK INDIANS, A FEDERALLY RECOGNIZED INDIAN TRIBE.

I. Eligibility: This giveaway is open only to those who are 21 years of age or older as of the date of entry and not on any exclusion list or banned/evicted list maintained or enforced by Wind Creek Bethlehem or its affiliates. This Wind Creek Tasting Tour giveaway (“Giveaway”) is only open to legal residents of the United States and is void where prohibited by law. Employees of Wind Creek Bethlehem, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of an Employee are not eligible to participate in the Giveaway. NO PURCHASE IS NECESSARY TO ENTER OR WIN.

II. Agreement to Rules: By participating, the contestant/participant/entrant (“You”) agrees to be fully and unconditionally bound by these Rules, and by such entry You represent and warrant that You meet all eligibility requirements. In addition, You agree to accept any and all decisions of Wind Creek Bethlehem as final and binding as it relates to the Giveaway, and Your eligibility to win.

III. Wind Creek Tasting Tour Giveaway Period: Entries will be accepted online on the Participant’s Instagram page and in-person (see section IV for how to participate) starting on January 12, 2026, at approximately 12:00 AM EST, and ending on February 12, 2026, at approximately 7:00 PM EST. All online entries must be received by February 12, 2026, at approximately 7:00 PM EST to be eligible to win.

IV. How To Enter: To enter the Giveaway, You must be twenty-one (21) years of age or older and You must pick up a Culinary Passport at one of the participating venues on Wind Creek Bethlehem’s property: Chop House at Wind Creek, Urban Table, MIXX, Steelworks Buffet and Grill, Bethlehem Barrel and Drafthouse, Twisted Tees, and Sweet Revenge. The Culinary Passport will direct You to visit each participating venue and to purchase one qualifying food or beverage item—the qualifying food and beverage item(s) at each venue are:

§ Bethlehem Barrel and Drafthouse:

· Spiked Eggnog (Mocktail version available upon request)

§ Chop House at Wind Creek:

· Lobster and Short Rib Pasta or

· Spiced Cranberry Margarita (Mocktail available upon request)

· Swedish Polar Bear Cocktail (Mocktail available upon request)

§ Steelworks Buffet and Grill:

· Mexican Hot Chocolate (Mocktail available upon request)

§ Sweet Revenge:

· Dubai Chocolate Coffee or

§ Twisted Tees:

Once a qualifying item is purchased, there are two (2) primary forms of entry into the giveaway (and two (2) separate prize packages). Participants can enter to win both prize packages (to increase their chance of winning), however, Participants can only win one prize package.

· Culinary Passport Social Media Giveaway:

1. To make an entry, You must take a photo or video of the qualifying food and beverage item purchased at the participating venue (see Section IV to view the participating venues and qualifying food and beverage items).

2. From there, You must post that picture or video onto your Instagram feed using the designated hashtag in the post copy, #WindCreekTastingTour, and follow and tag Wind Creek Bethlehem (@WCBethlehem) and the participating venue (example: if you purchase a qualifying food or beverage item at Urban Table, you need to follow and tag both @WCBethlehem and @UrbanTableWC). The Instagram tags for each participating venue are below:

3. Therefore, to make a valid entry, You must take a photo or video of the qualifying food or beverage item purchased at the participating venue (see Section IV to view the participating venues and qualifying food and beverage items). From there, You must post the qualifying picture or video onto your Instagram feed using the designated hashtag in the post copy, #WindCreekTastingTour, and follow and tag Wind Creek Bethlehem (@WCBethlehem) and the participating venue (see Section IV to view the participating venues and qualifying food and beverage items).

4. The maximum number of entries for the Social Media Giveaway is seven (7) total entries (one entry, per person, per purchase, per participating venue) plus, the ability to earn one (1) free entry option, below.

5. FREE Entry Option: To receive one (1) free entry (per person) take a picture of a Culinary Passport and post it to your Instagram Feed between January 12, 2026 at approximately 12:00 AM EST (or when a participating venue opens) and February 12, 2026 (ending at approximately 7:00 PM EST) using the designated hashtag, #WindCreekTastingTour, and follow and tag Wind Creek Bethlehem (@WCBethlehem).

· Culinary Passport Drop Off Giveaway:

1. To make an entry, You must visit one of the participating venues (see Section IV to view the participating venues and qualifying food and beverage items) and order one of the qualifying food or beverage items.

2. From there, You must present your Culinary Passport to the participating venue’s staff. A Team Member from the participating venue will give you one (1) Tasting Tour sticker, which will then be placed onto the participating venue’s designated section inside the Culinary Passport.

3. From there, Participants can return their Culinary Passport to any of the participating restaurants between January 12, 2026, starting at 12 AM EST (or when the first participating venue opens) to February 12, 2026, at 7:00 PM EST. One Tasting Tour sticker on the Culinary Passport equates to one entry. Participants can only receive one Tasting Tour Sticker per participating venue. If a Participant receives seven (7) Tasting Tour stickers, the Participant will receive seven (7) total entries plus one (1) bonus entry for completing the Culinary Passport, for a maximum of eight (8) total entries. If a Participant receives one (1) Tasting Tour sticker, the Participant will receive one entry.

4. Therefore, to make a valid entry, You must visit one of the participating venues and order one of the qualifying food or beverage items (see Section IV to view the participating venues and qualifying food and beverage items). From there, You must present your Culinary Passport to the participating venue staff. A Team Member from the participating venue will give you one (1) Tasting Tour sticker, which will then be placed onto the participating venue’s designated section inside the Culinary Passport.

5. Participants are limited to one (1) Culinary Passport per person. Only one (1) Culinary Passport submission will be accepted per participant. Any duplicate or additional Culinary Passports submitted by the same individual will be deemed invalid and will not be counted as additional entries. It is the sole responsibility of the participant to retain and present their original Culinary Passport when visiting participating venues and when collecting the Tasting Tour stickers. Failure to present the original Culinary Passport will result in disqualification or the inability to receive credit for participation. You will only receive one Tasting Tour sticker, per venue, per person, per purchase.

6. FREE Entry Option: To receive one (1) free entry (per person) submit a Culinary Passport (with your name and contact information) to Chop House at Wind Creek between January 12, 2026 at approximately 12:00 AM EST (or when the restaurant opens) until February 12, 2026 at approximately 7:00 PM EST (or when the venue closes).

Wind Creek Bethlehem and all participating venues (see Section IV for the full list of venues and qualifying items) have the full discretion to modify or substitute the qualifying food and beverage item for any reason, including dietary restrictions, food allergies, etc., though changes and substitutions are not guaranteed. Neither Instagram nor Wind Creek Bethlehem are responsible for any failed entry attempt by You. Neither Instagram nor Wind Creek Bethlehem are responsible for any Instagram post, designated hashtag, or a related issue failure that results in an ineligible entry by You—regardless of reason, even if such failure is the fault of Instagram or of Wind Creek Bethlehem.

By entering the Wind Creek Tasting Tour Giveaway, You agree to abide by these Rules and, by Your entry, You represent that Your Wind Creek Bethlehem’s Instagram posts, comments and any other forms of engagement submitted by You are completely Your own original work and such do not infringe upon or violate the rights of any third party, including intellectual property rights, copyrights, or rights of privacy or publicity.

Your entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to these Rules or specifications may be disqualified at the sole discretion of Wind Creek Bethlehem. You may only enter once, and You must provide all the information requested. You may not enter the Giveaway multiple times by using multiple accounts, identities, or devices to circumvent these Rules. If You use fraudulent methods or otherwise attempt to circumvent these Rules, all Your entries may be removed from eligibility at the sole discretion of Wind Creek Bethlehem.

V. Prizes: One (1) winner will be selected from each of the two (2) prize pools, one participant from the Culinary Passport Social Media Giveaway and one participant from the Culinary Passport Drop Off Giveaway, totaling in two eligible winners of the Tasting Tour Culinary Passport Giveaway. Each eligible winner of the Giveaway will receive a one (1) night stay at Wind Creek Bethlehem for two (2) (estimated retail value of $300/night), a $200 Wind Creek Bethlehem Gift Card to be used at any of the participating venues (estimated retail value of $200), and a 50 minute massage for two (2) at Spa at Wind Creek (estimated retail value of $400) at Wind Creek Bethlehem. The specifics of the giveaway prize shall be solely determined by Wind Creek Bethlehem. No cash or other prize substitution shall be permitted, except at Wind Creek Bethlehem’s sole discretion. All prizes are non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winners. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by a winner is permitted. Acceptance of any prize constitutes permission by You for Wind Creek Bethlehem to use Your and the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law. 

VI. Odds: The odds of winning depend on the number of eligible entries received.

VII. Winner Selection and Notification: The winners will be selected by random under the supervision of agents of Wind Creek Bethlehem. The winners will be notified on Wind Creek Bethlehem’s Instagram page and via phone/email within four (4) days following selection. Wind Creek Bethlehem shall have no liability for any winner’s failure to receive notices due to spam, junk e-mail or other security settings or for the winner’s provision of incorrect or otherwise non-functioning contact information. If any winner cannot be contacted, fails to claim the prize within four (4) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the winner’s prize may be deemed forfeited by Wind Creek Bethlehem in its sole discretion, and an alternate winner may be selected. Receipt by the winner of the prize offered in the Wind Creek Tasting Tour Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations as well as winner’s execution of a declaration and release in favor of Wind Creek Bethlehem. ANY VIOLATION OF THESE RULES BY WINNER (AT WIND CREEK BETHLEHEM’s SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS A WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

VIII. Rights Granted by You: By entering the Wind Creek Tasting Tour Giveaway, You understand and agree that Wind Creek Bethlehem, and anyone acting on behalf of Wind Creek Bethlehem, Wind Creek Bethlehem’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, Your entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. Acceptance of tickets constitutes the winner’s permission to use his/her likeness and name for publicity and/or promotional uses without compensation. To be a winner, You must sign a publicity release.

IX. Terms & Conditions: Wind Creek Bethlehem reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should any virus, bug, non-authorized human intervention, fraud, or other cause beyond Wind Creek Bethlehem’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, Wind Creek Bethlehem may select winners from all eligible entries received prior to and/or after (if appropriate) the underlying cause beyond Wind Creek Bethlehem’s control. Wind Creek Bethlehem reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Rules. Wind Creek Bethlehem has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to, multiple entries from the same user from different IP addresses. Multiple entries from the same computer in excess of that allowed by Giveaway Rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway shall be a violation of these Rules and result in disqualification. Should such attempt be made, Wind Creek Bethlehem reserves the right to seek damages to the fullest extent permitted by law.

X. Limitation of Liability: By entering the Wind Creek Tasting Tour Giveaway, You agree to release and hold harmless Wind Creek Bethlehem and its owners, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Your participation in the Giveaway and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; and/or (v) electronic or human error in the administration of the Promotion or the processing of entries.

XI. Disputes: Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF PENNSYLVANIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, You agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resorting to any form of class action, exclusively before a court of competent jurisdiction in Northampton County, Pennsylvania. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and You hereby waive all right to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than your actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway). You further waive all rights to have damages multiplied or increased. To the fullest extent allowed by law, You agree any litigation related to the Giveaway shall be by bench trial, and You further waive any right to a jury trial.

Requests must be received no later than (5) days after the first of every month.
